We reserve the right to modify, suspend, or discontinue any feature of the services at any time without prior notice.

    3. Subscription and Billing

    • Subscription Plans: Our services are offered on a monthly subscription basis. Current pricing is $297/month unless otherwise stated.
    • Billing Cycle: Your subscription renews automatically each month until cancelled. Payment is processed via the payment method on file at the time of renewal.
    • 30-Day Money-Back Guarantee: If you are not satisfied within the first 30 days, you may request a full refund. After 30 days, fees are non-refundable.
    • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

    4. Your Responsibilities

    • Provide accurate and complete information during onboarding and account setup.
    • Maintain the confidentiality of your account credentials.
    • Ensure that any content, data, or information you provide does not violate applicable laws or third-party rights.
    • Use the services in compliance with all local, state, and federal regulations, including telemarketing and consumer protection laws.

    5. Age Requirement

    You must be at least 18 years of age to access and use our website and services. By using our services, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms. You are responsible for complying with the terms and policies of those third-party platforms. We are not responsible for any data loss or service disruption caused by third-party providers.

    The services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee specific results, including lead conversion rates, response times, or revenue outcomes. Your results may vary based on numerous factors outside our control.

    10. Limitation of Liability

    To the maximum extent permitted by law, 60-Second Response System shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use our services. Our total liability shall not exceed the amount you paid in the preceding 12 months.

    11. Indemnification

    You agree to indemnify and hold harmless 60-Second Response System and its affiliates from any claims, damages, or expenses arising from your use of the services, your violation of these Terms, or your infringement of any third-party rights.

    12. Termination

    We may suspend or terminate your access to the services at any time, with or without cause or notice, if we believe you have violated these Terms or applicable law. Upon termination, all subscriptions and associated data may be removed.

    13. SMS (Text) Communications

    By checking the SMS consent box and providing your phone number, you agree to receive recurring automated text messages and calls from MMK Industries LLC d/b/a 60-Second Response System™ at the number provided. The following terms apply to our SMS program:

    • Opt-In: You opt in by checking the "Yes, text me reminders" box and submitting your phone number through our sign-up form. Consent is not a condition of registration.
    • Use Case Scenarios: Message types include reminders, follow-ups, and occasional offers related to your account and our services.
    • Message Frequency: Message frequency varies based on your account activity and the use case scenarios above. You may receive recurring automated messages as reminders, follow-ups, and occasional offers.
    • Opt-Out: Reply STOP to opt out anytime. Reply Help for help. Message and data rates may apply.
    • No Sharing: We do not sell your personal information, including your mobile number, to third parties. Your mobile number is used solely to deliver the SMS communications described above.
    • Carrier Liability: Your mobile carrier is not responsible for delayed or undelivered messages.

    14. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts having jurisdiction over our principal place of business.
